Welcome to the Age of Empires III: The Asian Dynasties Desktop Wallpaper Contest. These rules (these "Official Rules") set forth the rules and regulations of the Age of Empires III: The Asian Dynasties Desktop Wallpaper Contest (the "Contest") presented by iGames, Inc. ("Sponsor") and Microsoft Corporation ("Microsoft").
Please read these Official Rules carefully before submitting an entry or participating in the Contest. These Official Rules contain important information about eligibility to enter the Contest, the rules of the Contest and other important information. These Official Rules include an assignment by you to Microsoft of all your rights in the images and other materials you submit.
By registering for the Contest, you accept these Official Rules and agree to be bound by their terms. If you do not agree with these Official Rules, please do not register for the Contest.
1. Eligibility
The Contest is open only to residents of any State of the United States of America (other than Arizona, Colorado, Connecticut and North Dakota), the District of Columbia and any Province of Canada (other than Quebec) that are 13 years of age or older as of December 15, 2007, and who properly register for the Contest (each an "Entrant"). Entrants may be required to show proof of age and residence. IF YOU DO NOT SATISFY THESE REQUIREMENTS, YOU ARE NOT ELIGIBLE TO REGISTER AND/OR PARTICIPATE IN THE CONTEST. Participation in the Contest is also subject to compliance with the requirements specified below. Employees of Sponsor, Microsoft, their subcontractors and their immediate families (parent, child, sibling and spouses of each) are not eligible to register for the Contest. The Contest is void where prohibited by applicable law.
2. Contest Period
The Contest shall commence on December 15, 2007 and end on January 25, 2008 (the "Contest Period").
3. How to Enter the Contest
The purpose of this (skill based) Contest is for Entrants to create the best desktop image/graphic relating to the Age of Empires video game, based on the Judging Criteria as listed in section 5 below. From Friday, December 15, 2007 at 12:01am PST to Friday, January 11, 2008 at 11:59pm PST ("Submission Period") each Entrant may submit an unlimited number of Entries (each an "Entry") for the Contest. Each Entry must be submitted with the following process and requirements:
Any Entry Submission File as to which Sponsor is not provided a completed Entry Application will not be considered validly delivered and will not be eligible for a Prize.
4. Voting
Each valid and complete Entry will be posted on the Internet for viewing by the public. From January 14, 2008 to January 19, 2008 ("Voting Period") the public may go to AoE3 Wallpaper Contest Voting to vote for their favorite Entry. Votes are limited to one per person or IP address.
5. Judging of Entries
A panel of three (3) judges will review all eligible Entries received and select in order from 1st - 3rd, the top three (3) Entries as the winners (each a "Winner") based upon the following "Judging Criteria":

On January 25, 2008 the Winners placing in order from 1st - 3rd will be announced and Sponsor will award the prizes specified below (each a "Prize").
Each Winner will be required to execute and deliver to Sponsor a signed Affidavit of Eligibility, Assignment and Release (each a "Release") In the Release each Winner will (a) confirm his/her eligibility and agreement to these Official Rules, (b) to the extent permitted by applicable law, consent to use of his/her name and likeness, (c) release Sponsor from liability in connection with the use of the Prizes, and (d) confirm the assignment to Microsoft of all his/her right, title and interest in and to each Entry and Entry Application submitted. If required by law, each Winner also will be required to execute Federal and State tax releases. Sponsor will supply the Release to each Winner via email. Should a Winner not receive their Release for any reason, the Winner should contact Sponsor at events@igames.org for a copy. Each Winner must provide their Release and the tax releases to Sponsor within 14 days of the last day of the Contest Period, or the associated Prize will be forfeited. In the case of such a forfeiture, the Prize will be awarded in equal amounts to the other Winners who comply with the requirements set forth in these Official Rules. Winners will be mailed a check in the amount of their Prize within 2 weeks from the day Sponsor receives the completed Release and any required Federal and State tax releases. Prize checks will be mailed to the address indicated on the Release. The name of the Entrant must match the name listed on the Release.
By submitting an Entry and Entry Application, each Entrant hereby assigns to Microsoft all of such Entrant's right, title and interest in and to such Entry and Entry Application. This assignment is effective whether or not the Entry is awarded a Prize. Each Entrant also consents to the use of their name, information and image by Sponsor and Microsoft and their agents and assignees for display and publishing in any media, now known or hereafter developed, without compensation, in any and all advertising and promotional materials relating to the Contest, and in conjunction with other promotions that may be offered by Sponsor or Microsoft. The information collected to enter the Contest will be used to contact each Winner. Additionally, each Entrant agrees that Sponsor and Microsoft and their agents and assignees may use this information for marketing purposes and to contact Entrants regarding offers, promotions and other contests related to products or services distributed by Sponsor or Microsoft. In addition, any such information also may be used and disclosed as set forth in the Sponsor privacy policy located at http://www.igames.org/privacy_policy.asp.
9. General Release
Sponsor, Microsoft, all participating sponsors and their respective subcontractors will not be responsible for: (a) lost, late, incomplete, inaccurate, stolen, misdirected, undelivered and/or garbled Entries and Entry Applications, (b) technical failures of any kind, including, but not limited to telephone, electronic, hardware, software, network, Internet, or any other computer and communications related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; (d) any technical or human error such as printing or typographical or administrative errors in any materials associated with the Contest; or (e) the use of any Prize.
10. Winners List; Rules Request

11. Other Terms

Each Entry must be submitted with the following process and requirements:
- The background of the Entry must be 1024px by 768px, with any colors and features.
- Entry must be entirely the Entrant's original work.
- The Entry does not violate the rights of any other person or company by using their trademarks, logos, names or images.
- Each Entry must be in one (1) of these formats (.psd, .jpg, .jpeg, .gif).
- Submit each Entry in a .zip or .rar file and include a .txt file that lists full name, home address, email address and phone number ("Entry Submission File"). Name the Entry Submission File: YourFullName_Date_X where X corresponds to the number of Entries that you have submitted. For example: JohnDoe_120107_4.zip (if this is your fourth Entry).
- Only one Entry per Entry Submission File.
- Send each Entry Submission File to the following FTP:

Any Entry Submission File as to which Sponsor is not provided a completed Entry Application will not be considered validly delivered and will not be eligible for a Prize.
4. Voting
Each valid and complete Entry will be posted on the Internet for viewing by the public. From January 14, 2008 to January 19, 2008 ("Voting Period") the public may go to AoE3 Wallpaper Contest Voting to vote for their favorite Entry. Votes are limited to one per person or IP address.
5. Judging of Entries
A panel of three (3) judges will review all eligible Entries received and select in order from 1st - 3rd, the top three (3) Entries as the winners (each a "Winner") based upon the following "Judging Criteria":
- 25%: Relevance to Age of Empires III: The Asian Dynasties.
- 25%: Artistic appeal.
- 50%: The number of public votes received by an Entry during the Voting Period.
6. Prizes
On January 25, 2008 the Winners placing in order from 1st - 3rd will be announced and Sponsor will award the prizes specified below (each a "Prize").
- 1st Place: $250.00 usd
- 2nd Place: $150.00 usd
- 3rd Place: $100.00 usd
- All Prizes will be awarded.
- No Prize substitution, except as allowed by Sponsor which reserves the right to offer a prize of equal/greater value.
Each Winner will be required to execute and deliver to Sponsor a signed Affidavit of Eligibility, Assignment and Release (each a "Release") In the Release each Winner will (a) confirm his/her eligibility and agreement to these Official Rules, (b) to the extent permitted by applicable law, consent to use of his/her name and likeness, (c) release Sponsor from liability in connection with the use of the Prizes, and (d) confirm the assignment to Microsoft of all his/her right, title and interest in and to each Entry and Entry Application submitted. - Each Winner, by entering the Contest, consents to the inclusion of his or her name on a list of Winners made available by Sponsor and Microsoft as indicated below.
- Sponsor will pay the costs of delivery of each Prize.

11. Other Terms
- To the extent permitted by applicable law, the Contest and these Official Rules will be governed, construed and interpreted under the laws of the state of California, USA.
- These Official Rules are subject to any requirements/limitations imposed by the Federal Communications Commission.
- The Contest is subject to applicable Federal, state, provincial and local laws and regulations.
- Entrants agree to be bound by these Official Rules and by the decisions of Sponsor and the judges, which are final and binding in all respects.
- Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor.s reasonable control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Sponsor reserves the right in its sole discretion to disqualify any individual found to be tampering with the registration process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in a disruptive manner. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
